Zurich: Manor takes dispute to the Federal Court again
The Manor department store group is going back to the Federal Court in the dispute over the future of its branch on Zurich's Bahnhofstrasse.
Manor and the owner of the property, the insurer Swiss Life, have been disagreeing for more than four years about the terms and duration of the lease. Most recently, the Commercial Court ruled in favor of the property owner at the beginning of June. Accordingly, Manor would have had to move out of the building at Bahnhofstrasse 75 if it did not pay the higher rent demanded from January 1, 2014.
Those responsible at Manor, however, are of the opinion that the Commercial Court did not deal with the substance of their complaint, but only formal reasons led to its dismissal. Therefore, the department store group is now taking the case back to the Federal Court for clarification, as various media report.
In February of this year, the rental court in Zurich ruled that Swiss Life had not lawfully terminated the lease and that the department store would not have to move out until 2019 at the earliest. Swiss Life wants to convert the building and offer retail space only on the lower floors and make room for offices on the upper floors.
